MANNER OF SALE: This property will be offered as a MULTI-PARCEL auction in 6 individual tracts and in combinations of tracts on Tracts 1 thru 5. Tract 6 will be sold separately and will not be offered in any combination. It will be sold in the manner that produces the highest aggregate bid. There will be OPEN BIDDING on all tracts and combinations of tracts during the auction as determined by the auction company. Bids on individual tracts, tract combinations, and the total property may compete. Auction procedure and increments of bidding are at the discretion of the auction company.
TERMS: 10% down day of sale, with the balance to be paid on or before May 2, 2013, or upon such terms as may be acceptable to the Sellers. Personal and corporate checks are acceptable for the down payment with the final payment to be made in certified funds. All funds will be held by the auction company in their trust account or by an identified title/escrow company. Bidding is not contingent upon financing. Financing, if necessary, needs to be arranged and approved prior to the auction. Sale is subject to confirmation of the Haskell County District Court. Announcements made day of sale take precedence over printed material and previously made oral statements.
MINERAL RIGHTS: Mineral rights are subject to a prior reservation of record and Sellers will convey surface rights only to the Buyer(s) at closing.
WATER RIGHT INFORMATION: There is one irrigation well on this property covered under Water Right File #13878 and is permitted for 422 AF at 1,300 GPM. The water right will be offered as Tract 5. The water right covers 194 acres, and will be sold in one tract.
CROPS: There are no growing crops -- the land is all open at this time.
FSA INFORMATION: FSA cropland and base acres will be split by the Haskell County FSA office in the manner the land sells at the auction. 100% of all FSA payments associated with the 2013 crop year will go to the Buyer(s).
CLOSING: Date of closing will be on or before May 2, 2013.
REAL ESTATE TAXES: Sellers will pay taxes for all of 2012 and prior years. 2013 taxes will be the responsibility of the Buyer(s). (2012 taxes are combined for $1,052.20 and future taxes will be split by the Haskell County Appraiser in the manner the land sells at the auction.)
SURVEY: In the event the tracts sell separately, any survey work will be at Buyers expense.
ACCEPTANCE OF BIDS: Each successful bidder will be required to enter into a purchase contract immediately following the auction. Copies of the contracts will be available from the auction company prior to the sale.
EVIDENCE OF TITLE: Sellers will provide title insurance on Tracts 1-4 and 6 to the Buyer(s) in the amount of the purchase price with the premium to be paid one-half by the Buyer(s) and one-half by the Sellers. Title evidence will be provided on sale day.
ACREAGES: Acreage figures are considered to be approximate and are from reliable sources based on (USDA) FSA figures. All FSA information is subject to change, including but not limited to the number of cropland acres, grass acres, base acreages and yields. FSA acres may not be the same as deeded acres or county appraiser acres. Acreages are not covered by title insurance.
INSPECTIONS: Each potential bidder is responsible for conducting their own independent inspections and due diligence concerning pertinent facts about the property. Neither Sellers or Farm & Ranch Realty, Inc., its agents or representatives, are making any warranties about the property, either expressed or implied.
EASEMENTS: This sale is subject to all rights-of-way, easements, and zoning regulations, whether recorded or not, and to oil and gas leases of record, if any.

AUCTIONEERS NOTE: This excellent quarter adjoins the City of Sublette in Haskell County, Kansas. The water rights under this parcel can be purchased in any combination with Tracts 1, 2, 3, and 4, or it can be purchased separately and be severed from the surface of the land. The existing irrigation well is not operational at this time. It will be sold in its current as-is condition with no warranties.
The Buyers will have the option of purchasing individual tracts, combinations of the available tracts, or the property may be purchased in its entirety (including the water right), with the individual tracts competing against the whole or combinations of Tracts 1 thru 5.
