BROKER PARTICIPATION: A participating brokers commission will be offered to any licensed real estate broker who registers a customer/client who is the winning bidder and closes the transaction on any tract(s). This buyer broker fee will apply only to buyer prospects who are not legal residents or real estate owners in Kit Carson and Cheyenne Counties in Colorado, and in Sherman, Thomas, Wallace and Logan Counties in Kansas. Registrations will not be allowed for previous auction buyers, or from an agent whose prospect has previously contacted, or has been contacted by Farm & Ranch Realty, Inc., the seller and/or their representatives. Broker registration forms are available from the auction company and must be completed and returned no later than 72 hours prior to the auction.
MINERAL RIGHTS: Seller will transfer surface rights only to the Buyer(s) at closing.
WIND RIGHTS: Wind rights on Tracts 26 thru 34 are subject to a current wind lease and will be retained by the Seller. All other wind rights will transfer to the Buyer(s) at closing.
CROPS: All crops are subject to the tenants rights through the end of the 2012 harvest. Buyer(s) will receive the landlords share of all 2012 crops under the terms and conditions of the lease agreements. All lease agreements will terminate at the end of the 2012 harvest. Copies available upon request. ALL TENANTS ARE INTERESTED IN CONTINUING WITH A LEASE ARRANGEMENT WITH THE BUYER(S).
FSA INFORMATION: Buyer(s) will receive the landlords share of all FSA payments associated with the 2012 crop year. See chart below for base acreages.
CLOSING: On or before April 13, 2012.
POSSESSION: Subject to the terms and conditions of the current lease agreements on all properties except Tracts 11 and 12 where possession will be the date of closing.
REAL ESTATE TAXES: Seller will pay taxes for 2011 and prior years. 2012 taxes will be the responsibility of the Buyer(s). See chart on back for 2011 tax amounts.
ACREAGES: Acreage figures are considered to be approximate and are from reliable sources, based on (USDA) FSA figures. All FSA information is subject to change. FSA and deeded acres may not be the same.
INSPECTIONS: Each potential bidder is responsible for conducting their own independent inspections and due diligence concerning pertinent facts about the property.
