JUDE CHILDREN'S RESEARCH CENTER AND SHRINERS HOSPITAL) Reason For Sale: The church has closed due to declining membership. Thus the Trustees of the Plainview Baptist Church, Incorporated (Wm. Bellamy - President, Pat Bellamy Vice President and Frances Ridout Secretary) have decided to sell the property and have authorized the sale of the property at Absolute Auction. They have committed to donating net proceeds of the sale to benefit the St. Jude's Childrens Research Center and Shriner's Hospital. TRACT 1: PLAINVIEW BAPTIST CHURCH One story over basement, brick, church, vestibule, classrooms, basement, CH/CA. Situated on a 100' x 200' lot. TRACT 2 PLAINVIEW BAPTIST CHURCH FELLOWSHIP HALL One story frame structure, central hallway, two restrooms, kitchen, CH. Situated on an 80' x 100' lot. LOCATION: Property located on the north side of KY 10 between the rural communities of Plumville and Rectorville on KY 10 (Mason-Lewis Road) in eastern Mason County, Kentucky. Adjoins the Hillcrest Cemetery.
TRACT 1: Being a 100' x 200' lot located on the north side of KY 10 upon which the church is in place and as further described as follows:
That certain tract of land lying and being in Mason County, Kentucky on the Noth side of Kentucky Highway No. 10 in the Rectorville Precinct.
Beginning at a set stake in the North margin of KY Highway No. 10 N 54 W 80 feet from the corner of property owned by the Hillcreast Garden of Memories; thence N 36 E. 200 feet to a set stake; thence S 54 E. 100 feet to a set stake; thence S 36 W. 200 feet to a stake; thence with the line of KY Highway No. 10 N. 54 W. 100 feet to the place of beginning.
Tract 1 was originally conveyed to the Plain View Baptist Church by deed of William R. Dempsey et ux. Dated July 14, 1962 Deed Book 164 page 503 Mason County Court Clerk Records.
TRACT 2: Being an 80' x 200' lot located on the north side of KY 10 upon which the Fellowship Hall is placed and as further described as follows:
That certain tract of land lying and being in Mason County, Kentucky on the North side of Kentucky Highway No. 10, approximately six miles east of Maysville, Kentucky and being more particularly described as follows:
Beginning at a set stone in the north right0of-wa of KY. Highway No. 10, said point being the southeast corner of that parcel of land belonging to the Hillcrest Garden of Memories; thence with the Hillcrest Garden of Memories' line N. 36 deg. E. 200 feet to a set stake; thence with a line parallel to KY Highway No. 10 S 54 deg. E. approximately 80 feet to a set stake, said point being the Northwest corner of the Plainview Baptist Church's lot; thence with the Plainview Baptist Church's lot S. 36 deg. W. 200' to a set stake in the right of way of KY Highway No. 10; thence N. 54 deg. W 80 feet tot he place of beginning.
Tract 2 was originally conveyed to the Plainview Baptist Church by deed of Lillian Dempsey by deed dated the 6th day of April, 1971 as recorded in Mason County, Kentucky Deed Book 184 page 602.
Tracts 1 and II being the same property conveyed by deed of Plainview Baptist Church to Plainview Baptist Church, Incorporated by deed dated the June 3, 2019, as recorded in Deed Book 369 page 356 Mason County Court Clerk Records.
NOTE: The two adjoining tracts of land together provided for the site of the Plainview Baptist Church, parking areas, and Fellowship Hall and as such have been in use for the Plainview Baptist Church for many years, with Tract 1 conveyed to the Plain View Baptist Church in 1962 and with Tract 2 conveyed to the Plainveiw Baptist Church in 1971. When in operation, the structures were beneficial to each other and thus extensions of one building may have extended onto the adjoining lot, which was of little consideration or consequence when the church was in operation and as both lots were owned by the Plainview Baptist Church. However now that the church has closed, the parties hereto desire to sell the two parcels in whatever manner would conceivably result in the highest sales price. Therefore it is preferred that the two parcels be offered individually and then in combination and sold in manner producing the highest sales price. HOWEVER, it appears that there are certain overlaps between the two parcels (such as concrete slabs, parking areas, ramps, etc.) with some of these improvements situated on Parcel # 1 extending onto Parcel # 2 as well as some of these improvements being situated on Parcel # 2 and extending onto Parcel # 1. To have a completely new survey of the property with new boundary lines would result in requiring the properties go through the Mason County Planning Commission, and would require more time (and potentially expense) than what the sellers want to go through. Therefore, PROVIDED THAT IT CAN BE ARRANGED IN TIME, the sellers authorize the agent/auctioneer to obtain a survey with beneficial easements "in perpetuity" ("in perpetuity" means that these easements would be permanent, not temporary. These easements would last forever unless changed by mutual agreement between future owners of the property) in place to allow continued use of the overlapping improvements. If the surveys cannot be obtained in a timely fashion prior to the auction date, then it will be necessary to conduct the auction in a single parcel only, as a combination of Tracts 1 and II.
TERMS & CONDITIONS OF SALE - The Property is to be Sold upon the following Terms/Conditions: TERMS OF PURCHASE, REAL ESTATE: Property offered in Tracts and then in combination, sold at ABSOLUTE AUCTION, to the highest and best bidder regardless of price, NO RESERVE. The Trustees of the Plainview Baptist Church Incorporated have been provided with the definition of ABSOLUTE AUCTION as adopted by the Kentucky Board of Auctioneers and the auction shall comply with the terms of said definition. Purchaser(s) of real estate to place a NON-REFUNDABLE deposit (cash or good check) equal to 10 percent of the total purchase price with contract immediately following sale, with balance due in full with deed at closing on or before the 30th day of September, 2019. Terms of purchase are Cash to Seller: NO CONTINGENCIES OF ANY KIND PERMITTED. Possession with deed at closing. Sellers to maintain insurance coverage through date of closing (including liability; agent/auctioneer is not responsible for accidents); however successful purchaser will have an inherent and thus an insurable interest in the property as of date of sale and is encouraged to obtain insurance immediately upon sale as purchaser will assume risk of loss from under-insurance, lack of insurance, or in the event or case of fire or other disaster. Year 2019 real estate taxes to be payable by the purchaser (NO PRORATION), however any prior years taxes not current and paid shall be payable by the seller. Prospective purchasers are encouraged and advised to inspect the property thoroughly prior to sale as REAL ESTATE SOLD AS IS WITHOUT WARRANTY WHATSOEVER -- INCLUDING WITH REGARD TO FITNESS/MERCHANTABILITY/MARKETABILITY/ DESIRABILITY FOR ANY USE -- EITHER EXPRESSED OR IMPLIED. Based upon the dates that the two tracts were originally conveyed to the Plainview Baptist Church, it would appear likely that both structures were likely constructed prior to 1978, thus Lead-Based Paint could potentially be in evidence. Purchasers concerned about the possible presence of lead-based paint are encouraged to arrange and conduct --- at the prospective purchasers sole expense --- any inspections for the presence of Lead-Based Paint they so desire prior to purchase, as purchaser will be required to waive the rights to any contingency relative to any future testing or presence of Lead-Based Paint as a condition of purchase. Purchasers must have performed any and all due diligence inspections of the property prior to purchase, at purchasers sole expense --- including but not limited to: Whole House Inspection, Wood-Boring Insect Inspection, Radon Gas Inspection, Lead-Based Paint Presence, Phase I/II/III environmental hazard reports/ surveys, property surveys, appraisal, etc. --- as purchaser will not be permitted any contingencies for any type of testing or results thereof determined after the auction.
